KRAMER vs. KRAMER

Here is the scenario:  Madigan & Scirocco are against open government and are against bringing any change to Saratoga that will affect their little kingdom.  What is the relation?  Madigan who is worried that her name goes on all the checks might not have a job this fall and not because the form of government may change.  This election cycle operates the same way and a new form would not have elections until when we vote again in 2019 and take effect until 2020.  She is short changing citizens from voting on the issue in a special election that the State says is legal.  Secondly, the two of these shortsighted ‘leaders of our City’ are neck deep in two separate NYS Attorney General Investigation inside City Hall. Additionally, We will be losing most of our VLT funding because of the pending opening of the casino in Schenectady and neither one have proposed any solutions to the decline in revenues.

This is all happening at a time Madigan is signing checks to build a $750,000.00 bathroom for her finance people, for that price it will have golden toilets, sinks with golden handles and an extra size personal stall with an extra wide toilet for her royal highness the Princess Madigan.

I have it on a reliable source that this topic has already been discussed in a small group meeting. In the meeting with Finance, the staff agreed that said money would be available from the existing Fund Balance. True, it has not been ‘budgeted’, but there are ample funds available in the fund balance carried over from 2016, according to Finance staff.”

I also did research on the last 15 years of our city budget. We have consistently received high marks and compliments based on our budget practices. Once again Madigan takes all credit (naughty girl).

The Charter Review Commission has had many large group and sub-committee meetings, all of them open to the public since June 2016 and I don’t know how many Commissioners if any attended the invited Mayors, City Managers and Mayor/City Managers from cities around New York State who gave insightful information.  I know Madigan isn’t one of them nor has she even looked at any meetings on the City’s website as her erroneous comment below from the Daily Gazette:

“If approved by the voters during a special election set for May 30, take effect in 2019 — halfway through the two-year terms to which council members will seek reelection in November.

Ms. Madigan, if you were truly a representative of the people you would know the facts before opening your mouth.  There is a city election this year (11/17) for a normal 2 year term of the existing Commission Form of Government.  The election for 2019 again a regular timed city election would be to elect the new Council which would be sworn in on January 1, 2020.  This would be a normal transfer.  GET IT THROUGH YOUR HEAD.  Pay attention instead of being afraid of losing the power you use demeaning the citizens. 

Here is some information from the Daily Gazette:

“Public Safety Commissioner Chris Mathiesen argued that a council-manager form would make city government more efficient, more democratic and more representative of the people.
He called the commission form outdated and “inherently contradictory.”  “You can’t be a legislator and an executive at the same time,” he said. “This is the United States of America — this is not a dictatorship — so you have separate bodies, and you have a balance of power.

Well that’s missing in Saratoga Springs, and the ability for people to participate directly in city government is very limited.”
He added, “These five people all have too much power — each of them, including me.”
Mathiesen, who is joined by Mayor Joanne Yepsen in supporting a special election, said the other councilors appear to be blocking the review group’s efforts to create a charter that would eliminate their positions.

“There’s a real problem here in terms of conflict of interest,” he said.

He also said putting the charter on the ballot in November would be a “very bad idea.”
“I think it would mix up the issues regarding the referendum with the politics of the candidates who are running at that time,” he said.

“I don’t even know if I would run for commissioner of finance if the form of government is going to change,” she said. “Maybe I would run for mayor.”

 ‘Madigan said she doesn’t expect the group’s request for $37,000 in special election funding to be approved by the Council, refuting Turner's position that Municipal Home Rule Law 36 gives the commission authority to call for an election and have it be funded by the city.”
“I believe the Council has to take a stand on that,” Madigan said. “There’s not really a lot of case law in terms of municipal home rule law.”

And there is good reason that there have not many challenges. So, will the City sue itself?
Here is a copy of a recent legal opinion, look it up yourself.
The relevant provision regarding the scheduling of the election is Municipal Home Rule Law § 36(5)(b), which provides in relevant part:
(b) Such new charter or amendments shall be completed and filed in the office of the city clerk in time for submission to the electors not later than the second general election after the charter commission is created and organized. The local law or certificate establishing the commission or, in the absence of such provision therein, the charter commission shall provide for such publication or other publicity in respect to the provisions of the proposed charter or amendments as it may deem proper, and for submission thereof to the electors of the city at a general or special election held not earlier than sixty days after the filing thereof in the office of the city clerk and not later than the next general election which does not occur within the said sixty days, provided, however, that if such general election occurs within ninety days after the said filing, the proposed charter or amendments shall be submitted at such general election. [emphasis mine]

In an opinion from the Office of the Attorney General which concludes
We conclude that the local law or certificate establishing a charter commission may determine whether a proposed charter or amendments to an existing charter are to be submitted at a general or special election. In the absence of such a determination, the charter commission may determine the election at which the proposals are submitted to the voters for approval.   

The City of Saratoga Springs City Council did not place any restriction on the charter commission when it was formed in 2016, pursuant to MHRL § 36, it is the charter commission which determines whether to put the charter amendment to a vote at a general or special election.

“They are expending funds without the authority to do so right now, and that’s a problem for me,” she said. “My name goes on all the checks that go out from the city.”
So, she would be signing the checks for her new $750,000.00 ‘bathroom’’.

Now there is a movie Kramer vs. Kramer but I rather think the picture above is how Madigan & Scirocco look since they seem joined at the hip and Madigan has to write all of Sciroco's scripts (um).

    I nearly wet my pants laughing at this. Michael Richards( Kramer) looks just like Skip "Rusty" Scirrocco at City Council Meeting.
    Madagen and Rusty are making this simple issue and taking it way to far. The NYS Law is clear.The Charter Commission (Independent Group) is permitted to place the referendum in front of the voters at anytime. And the city is required to remain out of the way. That is what independent means.
    Please publish as much of the Charter Review Commission's findings during their time together. I watch their meetings and these people are really getting some good information. I was shocked how "broken" our city government is. 126 Days til we vote

    1. I think all 5 members voted for it, but it was the Comm. of Public Safety who transacted the deal and if I remember correctly he gave a lot of credit to his Deputy for putting the deal together.

  22. I read the letter from the AG that was sent to Mike Toohey who represented the Yeshiva. Dated Jan. 17, it is posted on another local blog. Deputy dog Finnergan was the author of the deal, and the letter states many times that there were "contracts" written. Unfortunately, nowhere in the AG ruling does it state that an experienced realtor was consulted. I doubt there is a Realtor out there who would have wanted to be involved in this sham of a deal.

  23. FIRE FIRE FIRE FRIDAY January 27th

    Friday night the DPW Employee Shelter and Carpenter Shop Burns. Apparently several DPW employees who have been using the facility as a homeless shelter caused a significant fire to break out late Friday night. Not a total loss, but well over $100,000.00 dollars of damage to the city owned welding and carpentry were lost. No DPW Employees names were released, but the cause appears to be smoking or cooking on site. City officials were not notified until Sunday afternoon. Just a few feet away are City's Fuel storage tanks.
    Several thousand gallons of fuel were at risk. Thanks to quick action by firefighters a major explosion was prevented.
    The city's voting machines also are store on the site. No damage to the voting machines.
    Skip Scirrocco refused comment.
    The DPW garage has become a pig sty in recent years with rumors of drug use and significant theft of city property.

    Madigan will promote an IT department technician as her new deputy.
    Susan Armstrong. Does she live in the city?

  29. My brother works at DPW and has for many years. He confirmed the story about the DPW guys living at the garage. He said it is a terrible place these days. Their tools come up missing all the time.
    Scirocco is never there and the management is very bad. I hope someone runs against him.

  31. Saratoga as we know it is over. The golden years of Caroline Street are quickly coming to an end. There is already unhappiness with the new corporate owners of Gaffney’s. A long-time bartender has been shown the door as well as 6 waitresses. The gaping holes caused by fire (suspicious in my opinion) and now some Brooklyn outfit is intending on building were Mio Posto once stood doesn’t quite pass the smell test. Increasingly, corporate America is encroaching on our special city called Saratoga. Max London’s, Stadium Café and Gaffney’s are no longer locally owned and we are losing our flavor here. The city lacks quality leadership. We could have lost our DPW garage last week due to lack of supervision. Who is in charge? Will Jim X be fired for nearly burning the place down? And the DPW commish isn’t commenting on this? This is why Unions don’t work people. It protects bad employees. Wake up Saratogians and save your town.

  33. Skippy has nada-nothing on his agenda for the next meeting. His deputy has left and the weldingshop/carpenter shop has burned and there is nothing on his agenda. The shop is a total loss with scorch marks visible from the road and plywood over the blown out windows. Yet there is no report to the council or the people of Saratoga.

    Rumor has it Donna is so angry with skippy that she is refusing to work or do any of the typing that he can not.

It's a travesty when a Commissioner doesn't immediately inform his constituents on important or current news of or about the City. Who is in charge? We need someone in charge and with a new form of government we'll have professionals and councilpersons who we can get the information from. Anyone who thinks this is wrong does not care about the future of Saratoga.

We now have a dog catcher as head of DPW, a Dentist as head of DPS and a Librarian as head of the Finance Dept. Your reference of a 'committee of two keep bringing this up' doesn't mean anything to me, it's a smart person that can see how ineffective this form of government is. You bring up Newburgh up just as you did last time and you think that is your shining example and that just shows your ignorance. There are hundreds upon hundreds of cities that use the City manager or strong Mayor form and are doing better that we are. I will again answer you when the Schenectady Casino is in operation for a while, our City will be losing most if not all of the amount of money the Racino give us, tourism will be down, hotel & restaurant business will be off as Schenectady and Albany will position themselves as attracting conventions and adding these mentioned businesses. However you think in that pea brained mined of yours that our current government can plan for the future? What's their answer so far, build more hotels? This is what happens when you have dog catchers, dentists and librarians running the City. I will however say that Commissioner Matheisen came to realize that this form of government doesn't work and will be the downfall of Saratoga as it has been for cities and towns around the country.

    7. Sorry but you moved here for the wrong reason. The unruly growth started in the late 70's and was never managed because of lack of professionalism and well thought out planning. The build, build, build has gone on for almost 40 years so it's too crazy to blame Keehn and Yepsen. The motto 'City in the Country' has been gone for many years now and its just as dumb as the saying 'If it a'int broke don't fix it'. So, if I were you I would move up North about 2 1/2 hours and you can find your place to live.

  35. Heard on the street.. Mr and Mrs Michelle Madigan showed up at the recent Planned Parent Gala and did not pay the admission. Some real class Ms Madigan. Watch how often she will be seen with Mark Baker now. Cause she wants Mark to run against Joaane Yepsen.

    2. If that is true Madagain has violated the ethics code by receiving gifts valued at more then $25 or is it $75?
      Write a letter of complaint to the ethics board listing the specific events as listed in the newspapers and ask her to produce a receipt proving that she paid. The ethics board can actually investigate this on their own, or better yet why does not Madagain ask them to investigate her clearing her name of these allegations?

  36. The city hired a full time planner back in the 80s. His name is Geoff Borneman. He failed at the architecture firm that he worked at and landed a cushy city job. Then he began attending night meetings, planning board, zoning board, city council and racked up huge amounts of overtime pay. But was he planning, or was he merely rubber stamping all the growth? Apparently, based on media reports about our current planner, Maynard, she actually has been doing research to HELP the developers. Is that the role of a planner??

  37. I don't think you're right about Borneman and the architecture firm that he worked at. Maynard attends every meeting you named that Borneman and she is responsible for the rampant growth in the years she has been in her job. Looks like no one likes managed growth. I would say that Maynard is rubber stamping all the growth, just ask Sonny Bonacio how easy it is to get all the permits.

Also, you just don't get it. I doubt the Mayor will be making that kind of money under the new form, in fact probably 1/2 that amount. Also, why would you say Yepsen will be the mayor? In 2 years you will be electing the Council and you don't have to vote for her if you don't want to. Also, the City Manager Assoc. has a list of Managers that want to move to other areas or smaller city's like ours or larger cities. You really don't know anything and are all mouth. I have the offense and defense as you have proved in your thread. You could have gotten this information from the internet or on Saratoga's website but you probably can't read so hopefully you have someone who can. No more talk for you, too stupid.

    How can the slowest news paper in the east have their words before they were spoken?

    “Frank Coppola has been an exemplary employee and leader in the Department of Public Works and I’m proud to appoint him as Deputy Commissioner,” said Scirocco. “Frank has been involved in a multitude of major infrastructure projects and will be extremely valuable in our continued work to improve our city’s infrastructure and manage the DPW workforce.”

    Coppola graduated from Saratoga Springs in 1997. He oversaw projects such as the installation of a 16-inch water main on Dyer Switch Road and a waterline extension along Route 9P to Regatta View. He repaired and replaced operating valves on North Broadway that were inoperable for up to 30 years.
    “I like to meet challenges and have done so throughout my career,” said Coppola. “I thought that I could contribute to DPW as deputy and put my own touch on solving issues and improving infrastructure projects.”
    Coppola thanked Scirocco for the opportunity, and said he’s looking forward to serving the people of his hometown.
    Coppola has led a hall of fame career as a driver and trainer at the Saratoga Raceway, earning an induction into the Saratoga Harness Hall of Fame in 2011. During his career, Coppola has won the horseman of the year award nine times, the leading driver title 11 times and over 5,000 total races. He has a career purse winnings of $17,038,430.
    “So many Saratogians are connected to the horse business in one way or another and Frank is another great local story,” said Scirocco. “His accolades on the racetrack are only matched by his professionalism as a DPW employee and I look forward to seeing what he can accomplish as deputy.”
    Coppola takes over for Tim Cogan who recently retired.
    Dugan-Armstrong served as the city’s website content coordinator. She’s responsible for the design and implementation of “Saratoga Mobile” the city’s smartphone application.
    Over the past seven years, Dugan-Armstrong owned and served as CEO of a computer company voted best computer store by readers of The Saratogian in 2010. Dugan-Armstrong managed the company finances, produced yearly budgets, prepared federal, state and local tax statements, ensured sales tax payments and managed the company payroll ensuring compliance with payment and reporting requirements.
    She has degrees in business and nursing, graduating at the top of her class from Mildred Elley Nursing School in 2007. She worked in the accounting department for Farm Credit Bank and also as a security specialist for Knolls Atomics power lab for eight years.

    1. Thanks for the information. We'll be explaining in a new post soon how Skippy's Deputy doesn't even live in the City which is required by our Charter. I guess Skippy can manipulate this Charter the way he wants, unbelievable. living in the City doesn't mean using your Mommy's address or owning an empty lot, it means where you eat, sleep & drink, which isn't in Saratoga. Now, Sorry Skippy, you may have to be brought up on ethics charges for knowing this and trying to circumvent the Charter.

    The building that burned was reported in the news as having minimal damage but it's now being considered a total loss.

  47. On May 30th, Saratoga Springs will hold a referendum on whether to approve a new charter for our fair city. Some people have asked why hold the charter referendum on May 30th instead of the city election in November. We believe it is the best way to ensure a vigorous democratic debate on these issues and a high informed debate.
    In a city election, the charter would be on the back of the ballot. When the citizen initiative charter came before voters in 2012, more than 2,000 voters failed to turn the ballot over and vote on the Charter. Why? They hadn’t heard anything about it. We hold presidential, state, local and school board elections at different times. Why? We don’t want to overload voters by placing too many issues on the ballot at the same time. At the November 2017, general election, the charter would have to compete for voters’ attention with five city council races, 2 county supervisor races, a judicial race, and a county referendum, and a statewide question on a Constitutional Convention. 2017 campaign spending is estimated to be approximately $750,000. Local free media coverage would be difficult to come by since the media would have to report on the mayoral, finance commissioner, public works commissioner, public safety commissioner, account commissioner, two county supervisors, a judicial race, the state-wide ballot question and a potential county referendum in addition to the City Charter.
    Some have suggested that there is something unusual about holding a referendum on the Charter separate from the city election. However, it is not unusual at all. A charter is not a Republican or Democratic issue, a Liberal or Conservative issue. It is a constitutional issue. Holding the charter referendum during a city election means that the charter vote would get wrapped up into the personal and partisan conflicts of the city election. When Britain voted on Brexit, they did so in a special election. When the United States approved the Constitution, we did in separate ratifying conventions separate from the normal elections.
    Holding the referendum in May gives city residents more than three months to focus on the issues, without the partisanship or politics of a general election. It will be the dominant local political issue and will receive extensive media coverage and debate among the citizens. When we reviewed the media coverage of the 2006 and 2012 charter votes, it was dominated by discussions of the personalities on each side rather than the merits of the proposal. Ask yourself, how many members were on the City Council? How long were the terms? How was the city attorney selected?
    Why May 30th, the Tuesday after Memorial Day? Originally, the Charter Review Commission proposed a date in April. Members of the City Council were concerned that some snowbirds might not be back by then and that an April date wouldn’t give voters enough time to study the issues. In response to the Council’s concerns, (and also to avoid holding the election on Tax Grievance Day or the day of the school elections) the Charter Review Commission selected May 30th. Primary nomination papers for the City Council start being circulated on June 7th. May 30th is the latest a special election can be held while also allowing new candidates to choose to run for the City Council based on whether the charter referendum succeeds or fails. Candidates can decide to run for office based on the new charter, based on what voters have to say for the general election
    Saratoga Springs’ voters are very educated and passionate about their city. They understand that deciding on a city’s constitution has serious consequences and deserves its day in the sun. The May 30th deadline will give voters 3 months- March, April, and May to study the issue. We plan on holding numerous town forums including one at 7pm on Monday, March 29th at the Saratoga Springs Public Library and 15 weekly information sessions throughout the city..

    Rusty Skip Scirocco has now hired Fast Eddie Miller for an open job at The City Water Department. Fast Eddie is also The Saratoga County Independance Party Chairperson. How will this work in November? Will Eddie Miller now endorse Skip now that he his skip's report at City Hall. Eddie is nearly broke! Eddie has his property on Bowman Street for 1 MILLION dollars and the city has listed it via accounts office at 288,000.00. I wish we all had this kind of profit margin.Skip and Eddie ran against each other in 2009. Eddie was pissed off because Skip had closed down his Hot Dog Stand in 2008. Joanne Foresta is Eddie's girl friend. Joanne is drinking buddies with Michele Madigan, so I know how this cozy situation happens. Scirrocco is a crook.

He lives off his girlfriend's money, and has had more failed business ventures than you can count! Hot Dogs, Taxi Service, Horse Trainer, Stable Owner. Hell, he used the McTygues for all they could do for him. Unsuccessfully ran against Skip & if he could only be honest with himself, he'd tell you what a looser he believes Skip to be. For him to now become employed by Scirocco is proof enough for me to vote for a new form of government for are city.

    Skippys brother heads the conservative committee. DPW buys all of its plumbing supplies from Skippy's brother's firm.
    Skippy is spending you tax dollars to protect his election results.
    Maybe he can hire Charlie Brown from the Dems to do some painting.
